Surrogacy: общие сведения
Surrogacy in India is tightly regulated and is not an open medical-travel treatment for foreign patients. Under the Surrogacy (Regulation) Act, 2021, surrogacy is permitted only for specified altruistic purposes and the law defines an eligible couple as a legally married Indian man and woman. An intending woman is also defined as an Indian widow or divorcee within the statutory age range. Commercial surrogacy is prohibited.
For eligible patients, the process requires more than fertility treatment alone. It includes a documented medical indication for gestational surrogacy, certification by the appropriate authority, medical and psychological assessment of the surrogate mother, insurance coverage and legal documentation concerning parentage and custody. Fertility specialists may also review ovarian reserve, semen parameters, uterine factors, prior IVF history and embryo-related considerations before planning treatment.
The surrogate mother must meet statutory eligibility criteria, and registered surrogacy clinics must comply with the Act and applicable Rules.
